This is such a tough call. How much similarity is too much? The hook that Jerry copied was just a few notes, and the chances are pretty good that a lot of composers will come up with them. Jerry took the notes in a different direction after the hook, so I think it is plausible that he honestly wrote the song without intentionally copying Mack's work.

You misunderstand. This ("Sunflower') isn't plagiarism; "Hello, Dolly" is. At least that's what the court ruled.

This song, written by Mack David, was the subject of a famous lawsuit. When the title song to "Hello, Dolly!" -written by Jerry Herman- became a hit, David sued, claiming that it was a rip of this song. Herman claimed that he had never heard this song before, but the rule is 8 consecutive notes the same, and it's plagiarism. The chorus certainly does sound like "Hello, Dolly!" and Herman had to pay Mack David a handsome settlement.
