The musical scale of the west has actually gotten higher in pitch since Beethoven's time. So when we play his music with our modern tunings they're technically wrong, as they're not what Beethoven intended, but it still works because good music works. And that's my limited understanding of music theory.

I'm afraid you are incorrect you are basing your general rules of art on the belief that there is a universal understanding of tones, rhythms and melodies that are programmed into us. I don't believe neuroscience is any where close to being able to confirm such a bold statement. To say that we all universally accept and enjoy the same certain tones is a complete leap of faith on your part, and thus your definition is unstable. Aesthetics is philosophy because there is so much left to understand.

Art can be objective if you set the right parameters of comparison. This, first of all is commercial art, it is meant to be sold and you are supposed to like it. Second, music has general rules that give us a framework of what is good or not. These rules are based on that our brains like certain tones, rhythms and melodies that are universally programmed within us. Commercial art is judged by the majority in the niche its sold to. This norm becomes the objective parameter for what is art.

You've just led yourself into a huge aesthetics debate that no one wins in. If I shit on a canvas is that art? Art is a subjective interpretation and there is no objective answer. One man's art is another man's shit. However any form of expression should be classified as art so yes the dildo vibration by that definition would be classified as art. This is only one definition though and many aesthetic philosophers would disagree.
