This is a crazy amount of respect for peach as tool, i commend them for this effort. No artist is ever as good as the original. Engineers strive for perfection. To an artist, there's no such thing as perfection. Poopie nanners!!!!!!!!!!!

Breaking Benjamin put their remastered cover of "Enjoy The Silence" by Depeche Mode on their greatest hits album, so I don't see why Tool can't do the same unless the original band has a problem with it.

As long as you change the song and play it your own specific way you don't need permission as it is covered under the 1st amendment (assuming you're american) but if you play the same song just like the original artist plays it you can't sell copies of it or claim that you own it over the internet.

In some cases you do need permission, it depends on the original artist/songwriter. Some don't care, some really do. And, of course, some labels love to file lawsuits. Maybe you don't need permission to just play it live or maybe there are other rules. But if you plan on making money on it you usually need permission. Just because so much gets ripped off online, and so much is Creative Commons, doesn't mean some people don't still care a great deal about copyright.
