The Devil was jealous of God's position, of our place as the crown of all creation, and wanted to be equal to the Throne of God. He tried to rise to the Throne of God by force, and then when that failed he pulled the crown of creation into sin and death? How is the Devil in the right there in anyway?

God is the creator, satan is just a creation, who by the mercy of God's love did not destroy him after all he has done. Limmited him and gave him time and in the end if satan does not change it will be his total end along with all that choice to follow his mistake and reject the true and only creator.
