There is no such thing as evidence of nonexistence, with a deity or anything for that matter. However the burden of proof is upon the person making the claim, if I were to say I have superpowers it's not your burden to prove that I don't, it's my burden to prove that I do. Also, Dawkins has stated that he is an atheist, not an agnostic. Agnostics tend to assert that knowledge of a deity, one way or the other, is unknowable. Most atheists would change their views if given evidence to do so.

There is no debate among biologists, the people that actually study this stuff, technically gravity is also "just a theory" too. Theory, by definition, is a well-confirmed type of explanation of nature, made in a way consistent with scientific method, and fulfilling the criteria required by modern science. Scientific theories are the most reliable, rigorous, and comprehensive form of scientific knowledge.
