I love this song, but... Fair Use under copyright law must be transformative, not merely derivative. Does the uploader do something new, or original, while using this work? A parody would be a good example. "Amount and Substantiality" The less of a work that is contained, the less likely it is to violate copyright. Lastly, what kind of effect does this have on the artist? It could be argued that this hurts sales, which would violate law. Just be informed, and keep uploading good videos.
